Terms and Conditions
This Web site and CHORE Masters’ memberships and services are offered to you, conditioned on your acceptance, without modification, of the following terms, conditions, and notices (the "Terms and Conditions"). Your use of this Web site or submission of service requests via telephone, email or text message constitutes your agreement to all such terms, conditions, and notices in effect at such time. If you have any questions regarding these Terms and Conditions, you may contact us at www.mychoremasters.com. We may amend these Terms & Conditions at any time by posting a revised version on the CHORE Masters Website. These Terms & Conditions were last updated on 02/08/13.
1. CHORE Masters SERVICES. At CHORE Masters we are committed to making your total experience a positive one. Upon entering your information and purchasing your membership, you may submit a request for a service provider. We will contact you (if needed) to gather more pertinent information, and work with you to schedule a service provider to complete your service request. However, we do not guarantee that we will be able to match your service needs with a service provider or that there are service providers in your area that are either capable or willing to complete your service needs. If your service request is beyond the scope of what our pool of service providers are capable of doing, we do make an effort to search for a new service provider to take care of your service request. We may or may not be able to provide you with a service provider that matches your unique needs. Although we take certain steps to examine the credentials of our listed service providers, we make no guarantees or representations regarding the skills or representations of such service provider or the quality of the job that he or she may perform for you. CHORE Masters may inform you of certain offers or discounts provided by a service provider; however, CHORE Masters does not guarantee or warrant the pricing on discounts that may be offered to you. The service providers are not employees or agents of CHORE Masters, nor is CHORE Masters an agent of the service providers. CHORE Masters residential and commercial membership plan includes: 1) Annual Personalized Property Assessment with a dedicated CHORE Masters representative to review immediate and ongoing maintenance and repair needs; 2) Organized Property “Wish List” from customer; 3) Property account management with digital records of all jobs completed through CHORE Masters; 4)Protected hourly rates on plumbing, electrical, handyman and HVAC for 1 year, pricing is based on franchise location and will vary from location to location as CHORE Masters is independently owned and operated; 5)Provider sourcing and management to services providers; and 6)Access to 24/7 emergency support services in case of property emergencies. Standard rates do NOT apply on emergency service calls and will be quoted at the time of service. Material costs are not included. Note: Commercial membership plans also include itemized monthly billing.
2. Additional CHORE Masters Services. Some additional services that may be requested by the Customer may include house cleaning, window washing, power washing, gutter cleaning, carpet cleaning, landscaping, lawn care or any other service relating to the property. Some of these services will require estimates and additional work orders to be obtained prior to performance. Standard rates do NOT apply to jobs requiring estimates and/or additional work orders.
3. CHORE Masters Fees and Payments. Payments for residential memberships can be paid annually or monthly at the then current rates. Rates for membership may vary depending on location. Payment for work completed via service requests is due within 30 days of invoice date. If customer authorizes payment via credit card, customer is authorizing CHORE Masters to charge the credit card the balance of any total charges due. If customer’s account becomes delinquent, CHORE Masters reserves the right to charge 1% per month late fee and may stop all services and transfer Customer’s account to a collection agency and Customer agrees to pay any and all reasonable attorneys fees, court costs and interest accrued in efforts to collect the overdue amount. Any and all legal means will be utilized to collect past due balances.
4. Cancellation terms. Memberships are annual contracts. If customer chooses to cancel services before the expiration of their contract, they will be charged for 35% of the outstanding balance for the remainder of the contract period. Customer must provide CHORE Masters with 30 days notice prior to cancelling.
5. Job Start/End Times. For hourly services CHORE Masters will charge from the time the service provider arrives at the Customer’s location, which includes unloading of supplies and remaining materials into providers vehicle, to the time that the service provider has concluded all requested services and loaded all supplies and remaining materials into providers vehicle.
6. Supplies and Equipment. CHORE Masters’ and its providers will provide all tools necessary to perform the requested services. Any necessary materials will be provided at cost or may be paid in advance by you. Any material prices quoted in an estimate may change should suppliers increase or decrease pricing on products or supplies. CHORE Masters cannot be held responsible for the prices set by suppliers.
7. Waiver of Accidental Damages CHORE Masters and its providers strive to be as careful as possible. If a part of the premises or an item within it is damaged while a CHORE Masters provider is performing work, our providers are instructed to notify us immediately in order to expedite a resolution. If an item or part of the premises is damaged or broken, CHORE Masters reserves the right to repair or replace the item. If CHORE Masters chooses to replace the item, the dollar value shall be that of the fair market value of the item immediately prior to the damage occurring. If you have an item that is irreplaceable or has sentimental value; CHORE Masters recommends that you store the item in a secure location away from any work to be performed.
INFORMATION YOU PROVIDE TO US. Upon using CHORE Masters’ services, you will be prompted to disclose certain information about yourself and your service requirements, and you will be able to store information, such as home services records, in our digital documentation system. Some of this information will be sent to service providers who will need this information to respond to you or to other persons or entities in connection with our business. By providing this information to us, or by submitting a service request, you are requesting, and you expressly consent to being contacted by us and by our service providers and providers via phone, fax, email, mail or other reasonable means, at any of your contact numbers or addresses, even if you are listed on any federal, state, provincial or other applicable "Do Not Call" list, in order that we may provide the services set forth on our site, to service your account, to reasonably address matters pertaining to your account or for other purposes reasonably related to your service request and our business, including marketing related emails. For complete details on our use of your information, please see our privacy statement. You agree that by completing a membership sign up, you are entering into a business relationship with CHORE Masters and thus agree to be contacted by CHORE Masters and/or its partners. You promise that all information you provide will be accurate, current and truthful to the best of your knowledge. If you provide any information that is untrue, not current or incomplete, or CHORE Masters has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, CHORE Masters has the right to refuse to provide any current or future services (or any portion thereof). You are responsible for any use of the CHORE Masters services by persons to whom you intentionally or negligently allow access to your password.
CALL RECORDING. You acknowledge and agree that CHORE Masters may monitor and/or record any telephone calls between you and CHORE Masters.
8. TO KNOWINGLY INPUT FALSE INFORMATION, INCLUDING BUT NOT LIMITED TO NAME, PHONE NUMBER, ADDRESS OR E-MAIL ADDRESS IS A VERY SERIOUS AND FRAUDULENT MATTER THAT COULD RESULT IN SIGNIFICANT COSTS AND DAMAGES INCLUDING INVASION OF PRIVACY RIGHTS TO CHORE MASTERS AND ITS SERVICE PROFESSIONAL PARTNERS, AND TO CONSUMERS, AS WELL AS THE LOSS OF TIME, EFFORT AND EXPENSE RESPONDING TO AND PURSUING SUCH FALSE INFORMATION AND REQUEST, AND FURTHER, COULD RESULT IN REGULATORY FINES AND PENALTIES. ACCORDINGLY, IF YOU KNOWINGLY INPUT FALSE INFORMATION IN A SERVICE REQUEST, INCLUDING BUT NOT LIMITED TO SOME ONE ELSE'S NAME, E-MAIL ADDRESS, PHYSICAL ADDRESS OR PHONE NUMBER OR A RANDOM OR MADE UP NAME, ADDRESS, E-MAIL OR PHONE NUMBER YOU AGREE TO FULLY INDEMNIFY AND BE LIABLE TO CHORE MASTERS AND EACH CHORE MASTERS SERVICE PROVIDER WHO ACCEPTS SUCH SERVICE REQUESTS, FOR THE GREATER OF: (1) A MINIMUM AMOUNT OF $11,000 TO EACH OF CHORE MASTERS AND EACH OF THE AFFECTED SERVICE PROFESSIONALS AND FOR EACH OF THE ACTUAL PERSON(S) AFFECTED BY ANY OF THE IMPROPER, INCORRECT OR FRAUDULENT INFORMATION YOU ENTER (FOR EXAMPLE THE ACTUAL OWNER OF THE E-MAIL ADDRESS OR PHONE NUMBER, ETC.), PER IMPROPER SUBMISSION, PLUS ANY ATTORNEYS FEES COSTS AND EXPENSE RELATING THERETO, IF APPLICABLE, OR (2) THE ACTUAL DAMAGES, DIRECT, PUNITIVE AND CONSEQUENTIAL, AND ANY REGULATORY OR JUDICIAL FINES OR PENALTIES THAT MAY ARISE FROM SUCH INTENTIONAL, MISLEADING, HARMFUL AND FRAUDULENT ACTIVITY, PLUS REASONABLE LEGAL FEES, COST AND EXPENSES RELATING THERETO, WHICH EVER IS GREATER.
NOTICE SPECIFIC TO DOCUMENTS AND INFORMATION AVAILABLE ON THIS WEB SITE. SERVICE PROFESSIONAL PRESCREENING PROCEDURES AND DISCLAIMERS. Unless otherwise noted or discussed, CHORE Masters uses the following criteria as part of its registration enrollment process ("registration") for new service professionals, with the exception of Corporate Accounts (as described below) and service professionals providing services in Canada (neither of which are screened) applying for membership in our network:
Licensing - CHORE Masters confirms at the time of a service providers registration, that a prospective new Service Provider has all applicable required state-level trade licensing. Certain states may require state-level licensing for projects above specified dollar amounts. We recommend you confirm these licensing requirements with the business and the applicable state and local licensing authorities. In some states, licensing may be required by the county or local authority in which the work is being performed. We recommend you confirm these licensing requirements before proceeding with your project. Larger projects often require the use of sub-contractors for specific types of work (for example, a kitchen remodel may require an electrician or plumber). These types of projects are usually beyond the scope of work for CHORE Masters. In instances when a project requires the use of sub-contractors and a General Contractors license, CHORE Masters will provide a referral to the customer to complete services and recommends that you check these licenses as a referred General Contractor may or may not have undergone CHORE Masters prescreening procedures. *Requirements specifically to California residents: CHORE Masters relies on representations of service professionals that are using a California General building contracting license to cover home improvement tasks, that such service professionals are performing more than one task as defined and required by California licensing rules. We always recommend that you ask the business to provide you with a copy of their license. CHORE Masters does not check state-level or provincial level trade licensing for photographers.
Corporate Accounts - Some Service Providers are employees, franchisees, dealers, or independent contractors ("Corporate SP's") of larger national or corporate accounts ("Corporate Accounts"). In such event, you may be matched with the Corporate Account entity or with one of their Corporate SP's. The above screening criteria is not applicable to Corporate Accounts, and therefore, CHORE Masters does not screen the Corporate Accounts or Corporate SP's.
The above procedures may change from time to time at the sole discretion of CHORE Masters. CHORE Masters believes that it uses commercially reasonable methods to check these matters but does not make any representations or warranties that members are appropriately licensed or free of significant state-level civil legal judgments while they are members, or thereafter. CHORE Masters does not represent or warrant that the information received from state, provincial or other government agencies or from third party sources is accurate, error free, or that it is up to date or updated at the time that CHORE Masters checks such information. Most agencies have periodic update cycles or schedules and this information is not updated on a real-time basis by such agencies and third party sources.
DISCLAIMER: CHORE MASTERS EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED RELATING TO THE PRESCREENING PROCESS, CRITERIA, PROCEDURES, OR INFORMATION OBTAINED OR PRESENTED IN THE PRESCREENING PROCESS OR DISCLOSURES INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR USE, OR THAT THE SCREENING OR VERIFICATION PROCEDURES OR STANDARDS ARE SUFFICIENT OR THAT THE INFORMATION RECEIVED IN THESE SCREENING OR VERIFICATION PROCEDURES IS ACCURATE, TIMELY OR ERROR FREE.
9. ARTICLES AND OTHER CONTENT. CHORE Masters provides certain content relating to home improvement, repair, maintenance ("Articles"), on the CHORE Masters website, and via mobile applications owned and operated by CHORE Masters. Such Articles are provided "As-Is", without any warranties or representations, and you assume all liability and responsibility for your use of such Articles. You understand and agree that the Articles do not provide advice and are no substitute for the advice of a professional.
10.Independently Owned and Operated. You hereby acknowledge and understand that the above listed CHORE Masters is an independently owned and operated franchisee of CHORE Masters Franchise Development, LLC and you hereby agree to release CHORE Masters Franchise Development, LLC, and its officers, directors, affiliates, employees and agents, and any other person, firm or entity from any damages or claims, including consequential and incidental damages, of every kind or nature, suspected and unsuspected, known and unknown, and disclosed or undisclosed, arising out of or in any way connected with such disputes and your dealings with the above listed independently owned and operated franchisee or its providers.
